Important – please read carefully. These Terms and Conditions govern your access to and use of the Sports Labs Ltd website at www.sportslabs.co.uk (the “Site”). By accessing or using the Site in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the Site immediately.

References to “Sports Labs”, “we”, “us”, or “our” in these Terms mean Sports Labs Ltd. References to “you” or “your” mean any person accessing or using the Site.

2. Scope of These Terms

These Terms and Conditions apply exclusively to your use of this website. They govern how you may browse, interact with, and use the content, features, and functionality of the Site.

These Terms do not govern any commercial, testing, certification, consultancy, or other professional services that Sports Labs may provide. Any such services are subject to separate written agreements between Sports Labs and the relevant client.

By using the Site you also agree to our Privacy and Data Protection Policy, available at www.sportslabs.co.uk, which is incorporated into these Terms by reference.

3. Changes to These Terms

We reserve the right to amend these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Site after any such changes constitutes your acceptance of the updated Terms. We therefore encourage you to review this page periodically.

We may also update, modify, suspend, or withdraw the Site (or any part of it) at any time without notice, and we will not be liable to you if, for any reason, the Site is unavailable at any time or for any period.

4. Permitted Use of the Site

You may use the Site only for lawful purposes and in a manner consistent with these Terms. In particular, you may browse the Site’s content for personal or professional information purposes, submit enquiries through the contact form, subscribe to our newsletters (Field Notes and Pitch Matters) where the option is made available, download publicly available documents and publications, and share links to pages on the Site provided you do so in a fair and lawful manner that does not damage our reputation.

5. Prohibited Use

You must not use the Site in any way that violates any applicable local, national, or international law or regulation.

You must not use the Site in any way that is fraudulent, deceptive, or misleading, or has any fraudulent purpose or effect.

You must not transmit, distribute, or upload any unsolicited or unauthorised advertising or promotional material (spam).

You must not knowingly introduce viruses, trojans, worms, logic bombs, or other malicious or harmful code.

You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.

You must not attack the Site via a denial-of-service attack or a distributed denial-of-service attack.

You must not harvest, scrape, or data-mine any content from the Site using automated tools or processes without our prior written consent.

You must not misrepresent your identity or affiliation with any person or organisation.

You must not infringe the intellectual property rights of Sports Labs or any third party.

You must not post, submit, or transmit any content that is defamatory, offensive, obscene, discriminatory, or otherwise objectionable.

A breach of this clause may result in immediate termination of your right to use the Site. We may report such a breach to the relevant law enforcement authorities and will cooperate with them by disclosing your identity or other relevant information as required. Unauthorised access also constitutes a criminal offence under the Computer Misuse Act 1990.

6. Intellectual Property

6.1 Ownership

The Site and all of its content, including but not limited to text, articles, field notes, images, photographs, videos, logos, graphics, icons, data, software, and the overall design and layout, are owned by or licensed to Sports Labs Ltd. The content is protected by copyright, trade mark, database rights, and other intellectual property laws in the United Kingdom and internationally.

The Sports Labs name, logo, and associated marks are trade marks of Sports Labs Ltd. You may not use our trade marks without our prior written consent.

6.2 Permitted Use of Content

You may print one copy and download extracts of any page(s) from the Site for your personal, non-commercial reference. You may also draw the attention of others to content posted on the Site.

You must not modify the paper or digital copies of any content you have downloaded or printed. You must not use any illustrations, photographs, video, audio sequences, or graphics separately from the accompanying text. You must not use any content from the Site for commercial purposes without obtaining a licence from us. You must not remove or obscure any copyright or trade mark notices from materials obtained from the Site.

6.3 Field Notes and Technical Publications

Our Field Notes publications and technical articles are made available for informational and educational purposes within the sports surfaces industry. Reproduction or redistribution of this content, in whole or in part, in any medium, requires our prior written consent. You may share links to Field Notes articles freely.

7. Content You Submit to Us

Where the Site permits you to submit content, including enquiry form submissions, newsletter sign-ups, CV submissions, or any other communications, you agree that any content you submit is accurate, truthful, and not misleading; that you have the right to submit it and that it does not infringe any third party’s rights; and that it is not defamatory, offensive, unlawful, or otherwise objectionable.

By submitting content, you grant Sports Labs a non-exclusive, royalty-free licence to use, store, and process that content solely for the purposes described in our Privacy and Data Protection Policy.

We reserve the right to discard, delete, or decline to act on any submission at our sole discretion.

8. Accuracy of Information on the Site

While we make every effort to ensure that the information on the Site is current, accurate, and complete, we make no warranty or representation, express or implied, as to its accuracy, completeness, or fitness for any particular purpose.

Content on the Site is provided for general information only and does not constitute professional, technical, or legal advice. Service descriptions, accreditation listings, and governing body affiliations are subject to change and should be verified by contacting us directly. Any standards, specifications, or technical information referenced on the Site reflects the position at the time of publication and may have since been updated by the relevant governing bodies.

Nothing on the Site constitutes an offer capable of acceptance so as to form a binding contract for any services. All services are subject to separate written agreements.

The Site contains links to websites operated by third parties, including governing bodies (such as FIFA, World Rugby, FIH, ITF, FIBA, World Athletics, and IHF), trade associations (such as SAPCA, ISSS, ASBA, and ASTM), and our affiliated international offices.

We have no control over the content of those websites and accept no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of a link does not imply our endorsement of the linked website or its operator.

When you click on a link to a third-party website, you leave the Site and are subject to the terms and privacy policies of that third party. We encourage you to read those policies before submitting any personal data to a third-party site.

10. Social Media

The Site links to Sports Labs’ official social media profiles on LinkedIn, X (Twitter), Facebook, Instagram, and YouTube. Use of those platforms is governed by the terms and privacy policies of the respective platform operators, not by these Terms.

If you tag, mention, or share content relating to Sports Labs on any social media platform, you grant us permission to repost, share, or otherwise engage with that content in connection with our promotional and informational activities, subject to any platform-specific rules. We will always endeavour to credit the original poster where appropriate.

11. Cookies

The Site uses cookies and similar tracking technologies to improve your browsing experience, analyse site traffic, and (where you have consented) enable analytics functions. Our use of cookies is described in full in our Privacy and Data Protection Policy, which forms part of these Terms.

12. Disclaimer of Warranties

Nothing in these Terms affects your statutory rights as a consumer under applicable law, where those rights cannot be excluded.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Sports Labs Ltd shall not be liable for any direct, indirect, incidental, special, consequential, or punitive loss or damage arising out of or in connection with your use of, or inability to use, the Site. This includes but is not limited to loss of income or revenue; loss of business, contracts, or anticipated savings; loss of profits or loss of data; wasted management or office time; or any indirect or consequential loss, however caused.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot lawfully be excluded or limited under applicable law (including the Consumer Rights Act 2015 and the Unfair Contract Terms Act 1977 where applicable).

We assume no responsibility for the content of any third-party websites linked from the Site. Such links should not be interpreted as endorsement by us of those sites.

14. Website Availability and Security

We do not guarantee that the Site, or any content on it, will always be available or that access will be uninterrupted. We may suspend, withdraw, discontinue, or change all or any part of the Site at any time without notice.

You must not misuse the Site by knowingly introducing malicious code or by attempting to gain unauthorised access to the Site or its underlying infrastructure. Breach of this clause constitutes a criminal offence under the Computer Misuse Act 1990. By using the Site, you consent to processing of your personal data in accordance with our Privacy and Data Protection Policy. You warrant that all data you provide is accurate.

Sports Labs Ltd is the Data Controller for any personal data collected through the Site, and we process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

16. Newsletter Subscriptions

The Site offers the ability to subscribe to our Field Notes and Pitch Matters newsletters. By subscribing, you confirm that you are the owner or authorised user of the email address provided, that you consent to receiving the relevant newsletter communications from Sports Labs, and that you are aged 18 or over.

You may unsubscribe from any newsletter at any time by clicking the unsubscribe link in any email we send, or by contacting us at info@sportslabs.co.uk. We will process your unsubscribe request promptly and in accordance with our Privacy and Data Protection Policy.

17. Contact Forms and Enquiries

Use of the contact form on the Site is subject to these Terms and our Privacy and Data Protection Policy. You agree not to submit any content through the contact form that is unlawful, defamatory, offensive, or in breach of any third party’s rights.

Submission of an enquiry through the Site does not create any contractual relationship between you and Sports Labs, and does not constitute a binding offer or commitment by either party. Sports Labs is under no obligation to respond to any enquiry.

18. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the law of Scotland.

The courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter. However, if you are a consumer, you may also have the benefit of mandatory provisions of the law of the country in which you are resident, and nothing in these Terms affects your rights under those provisions.

If you are accessing the Site from outside the United Kingdom, please be aware that the Site is directed primarily at users in the UK and that content may not comply with the laws of your jurisdiction. Sports Labs makes no representation that the Site’s content is appropriate for use in all locations.

19. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any modification or deletion of a provision shall not affect the validity and enforceability of the rest of these Terms.

20. Entire Agreement

These Terms, together with our Privacy and Data Protection Policy and any other legal notices published on the Site, constitute the entire agreement between you and Sports Labs Ltd in relation to your use of the Site. They supersede all prior agreements, representations, and understandings between us relating to the same subject matter.

No failure or delay by Sports Labs in exercising any right or remedy provided under these Terms or by law shall constitute a waiver of that or any other right or remedy.
